Mr. Femi Falana, a Senior Advocate of Nigeria has stated that, only sitting governors and the president have immunity from prosecution.

He made this statement after police officers attached to the incumbent Governor of Kogi State, Usman Ododo
prevented former Governor Yahaya Bello from being arrested by the Economic and Financial Crimes Commission (EFCC).

In a video shared on YouTube by Channels TV, Falana said according to the Supreme Court, only the president and sitting governors enjoy immunity from prosecution.

He stressed that no other citizen can be shielded by the police from facing legal action.

He pointed out that doing so would violate the constitution by unfairly protecting certain individuals while others face the consequences of the law.

He called upon the Inspector General of Police to ensure compliance with the Federal High Court’s order to bring Yahaya Bello to court for arraignment.

In Falana’s words: “Supreme Court said nobody in Nigeria apart from President and Governors has immunity.

“Any other citizen can not be shielded by the police from prosecution.

“That is the law, otherwise, we are violating the constitution by shielding certain suspects from going to court to defend themselves while other citizens are being railroaded to jail via the courts.”
